TERMS AND CONDITIONS 

Please read these Terms and Conditions carefully. Your access to and use of the service is conditioned on your acceptance of and compliance with these terms. These terms apply to all clients who use the services provided. By accessing or using the service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

MEMBERSHIP AND FEE

MYOSET offers a monthly minimum term membership. Members must be at least 18 years of age. For this membership payments will be due in advance and will be collected on or around the 1st of each month. This membership has a minimum term of 3 months and will continue on a roll on a monthly basis once the minimum terms have expired. Upon joining members shall pay a non-refundable joining fee at the rate specified.
Payment of monthly membership can only be made by Direct Debit from a UK bank account. Members must keep MYOSET informed of their up to date contact details. All communications shall be presumed to have been received within 5 days of the postmarked date, or ‘sent’ date if via email.
All membership fees are reviewed annually usually on the 1st January, members will be notified of any changes by email giving one full calendar months’ notice. The Company reserves the right to refuse a membership application from any applicant for any reason. Membership is non-transferable and non-refundable.
If paying via direct debit and you fall behind on your membership fees, MYOSET reserves the right to temporarily refuse your access to the club until full payment has been made. If any monthly fees or charges incurred are not paid within 30 days after they are due, the clinic may terminate your membership. MYOSET may pursue any rights it has to recover the unpaid amount by referring any missed payments to a debt collection agency, where additional fees may be incurred. Upon termination of membership, no refund of the admin fee, monthly fees or other fees shall be issued.
To re-join the Clinic after a termination of membership, any unpaid subscriptions must be cleared, a new membership agreement completed and the prevailing admin fee may be charged.

USE OF FACILITIES AND SERVICES

Clinic opening hours are fixed by the Company and are subject to change without prior notice. The Company may at any time close the Clinic’s premises, without notice, in order to; execute repairs, alterations, accommodate external events, re-decorations or otherwise, to facilitate Clinic programmes or on certain holidays.
Members are requested to arrive at the clinic for appointments and studio classes 10 mins before the official start time. An instructor or therapist may refuse entry or treatment, if a Member arrives later than the start time, or may ask any Member to leave a class if they feel theirs, or another’s, safety or enjoyment is in jeopardy.
The Company reserves the right to refuse entry to the Clinic’s premises at its. Please see our appointments and cancellation policy for more information.
It is the Member’s or guest’s responsibility to ensure that they are capable of undergoing any activity within the Clinic. All activities and treatments are pursued at the Member’s own risk.
Whilst every effort has been made to ensure the accuracy of the class programme, the management reserves the right to cancel or reschedule classes after publication and at short notice. The programme may be amended during public holidays.
Smoking is not permitted anywhere in the Clinic. Members or guests shall not use the Clinic’s facilities whilst under the influence of alcohol or drugs. In the event they do so, this is entirely at their own risk.
Be considerate of others; loud or abusive language will not be tolerated. Removal of Clinic property from the premises may result in the termination of membership privileges and legal action.
If a Member fails to attend an appointment without providing a minimum of 24 hours notice, the Clinic reserves the right to charge the full cost of the appointment. Please see our appointments and cancellation policy for more information.

DATA PROTECTION

Your data privacy and security are important to us. We want to be completely clear about how we use it. Please note that at Myoset all data thus captured will be used and held in accordance with the requirements of the Data Protection Act 2018. For further details please refer to our Privacy Notice (Insert shortcut link to the privacy policy), which explains how we collect, store and handle your personal data.

CANCELLATION OF MEMBERSHIP

Monthly membership cancellations must be received by the 1st of each month. A full calendar month’s notice and payment is required for cancellation. For example, if a cancellation request is received on or before the 1st September, only the month of September will be due, however if received on 2nd September both September and October will be due.
Requests for cancellation must be made via email to info@myoset.co.uk. You will receive an email confirmation from our team to confirm this has been processed. Verbal instructions to amend or cancel a membership cannot be accepted, all requests must be in writing.
Monthly fees and/or prepaid fees are not refundable. Ex-members wishing to re-join the clinic will be asked to pay a joining fee plus any unpaid balance from the previous membership.
The Company shall have the right to suspend or withdraw Clinic privileges or membership from any Member who, in their opinion, has abused privileges or conducted themselves in a manner deemed detrimental to the Clinic staff or its Members. Such suspensions or cancellations shall become effective immediately and no reimbursement will be issued to such Members of the prorated portion of their unused monthly fees. There will be no refund of the joining fee.

FREEZING MEMBERSHIP

Requests for freezing shall be at the sole discretion of the Club. You cannot freeze in your first month of membership. A freeze request must be submitted by the 20th of the month for it to be valid from the 1st of the following month.
For example, if a freeze request is received on or before the 20th September, your membership will be frozen as of 1st October, however if received on 22nd September your freeze will come into effect on 1st November, this is due to processing time and direct debit amendment. 
There is a monthly fee of £5 to freeze your membership, Payment will automatically be debited using your regular subscription method, annual members will need to pay in advance by card.
Members can freeze their membership twice per calendar year, minimum one month, maximum three. The minimum freeze period is one month, however you can unfreeze your membership early, a prorated value will be due for the rest of the month. Extension or amendments to your freeze must be made in writing via email.
Monthly subscription payments will recommence automatically at the end of a freeze period without additional communication, subscription billing runs from 1st of the month, your freeze period may not coincide with your billing. Your membership needs to be live if you wish to serve notice to cancel your membership.
As your membership is not active during the freeze period, these months do not count towards your initial minimum term. Thus extending the terms of your membership. For example, if you freeze your membership for two months these two inactive months will be added onto your contract period.

APPOINTMENTS CANCELLATION POLICY

A £40 deposit is required at time of booking and the remaining value will be charged directly after your appointment, unless using your MYOSET membership. Before booking an appointment with us, we encourage all clients to read our FAQs section. This provides key details on what you can expect from us during your appointments.
We have a 24 hour cancellation policy. For late cancellations and no shows, you will be charged in full. For those using the MYOSET membership, a session will be removed from your monthly subscription the same applies for bundle sessions.
Please note, if you use private medical insurance, the fee for cancellation will fall to yourself.
PRIVATE MEDICAL INSURANCE CLAIMS
We can bill some insurers directly for your treatment, however this does not apply to all. Please check with us when booking. For other insurance claims we can provide an invoice for you to submit to your insurance. Please note, you remain responsible for the cost of your treatment and the charge will automatically revert to you if your insurer does not make payment in full within 60 days.

CLASS CANCELLATION POLICY

Please read our Myoset Move Yoga and Pilates class class cancellation policy below;

Cancel within 8 hours £5

Cancel within 2 hours £10

No show fee £20 or loss of class credit

FIRST TIMERS: 

You are required to arrive 15 minutes prior to your first class so you can have a full induction on the necessary equipment and fill out our health & safety waiver form. If you fail to do this, you will be refused entry to class and will lose your credit.  

REGULARS: 

We have a 5-minute grace period if you are running late to class, and only if it is not your first time with us. However, if you are more than 5 minutes late you will be refused entry to class and lose your credit. 

PACKAGE DETAILS

All packages purchased are non-refundable. They are valid for a period of 3 months from the date of purchase and cannot be shared or transferred to another client. Please note the cancellation policy remains the same for package sessions.

CARD DETAILS

Card details for all patients are taken at time of booking. These are stored securely with Mastercard. These details are stored in line with our cancellation policy. Once your course of treatment is complete your card details will be removed from our system. If requested otherwise they can also be removed.

CHANGES

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the service.
